Continuance: No charge for first continuance of a mediation if notice received more than 15 calendar days before mediation setting. Administrative fee of $200 for continuances on less notice and for second continuances if notice more than 15 calendar days. Up to 50% charge, at Mr. Tanksley's discretion, for continuances on less than 15 calendar days notice or for any third continuance or for any second continuance of a multi-day session.

 

Cases of over $100,000 in controversy; Same provisions except rates increased as follows:

Daily: $2,400 ($1,200 per side). Note: If counsel requests additional preparation time by Mr. Tanksley, $250 per hour is charged for it. If more than one day is scheduled, the daily rate is lowered to $2,000 for up to 8 hours mediation time for 2nd and subsequent days.

Half-Day: $1,200 ($600 per side). Note: the hourly rate of $250 per hour applies if counsel requests additional preparation time by Mr. Tanksley or if counsel requests to extend the session (assuming availability).

Hourly: $250 per hour, minimum 4 hours includes administrative charge and required minimum 1 hour preparation time and 3 hours mediation time.

Payment Required in Advance: Full payment for the session (for at least the first day if multiple days are scheduled) is to be deposited with Mr. Tanksley in advance and promptly after the request for scheduling. No scheduling is confirmed without receipt of such full advance payment. In the event of scheduling a multi-day mediation, full payment for the second day and any additional days is required in advance before the start of the first day's mediation. Notwithstanding the above, if there is any remainder due, counsel will be invoiced proportionately.

 

Greater Las Vegas/Henderson Area:

Cases under $100,000 in controversy (counsels' good faith estimate):

Daily: $1,600 ($800 per side) per day, includes administrative, 2 hours of preparation and up to 8 hours daily mediation time (with working lunch). Start can be between 8:00 AM and 10:00 AM as desired. Saturday sessions may be available.

Half-Day: $800 ($400 per side) includes administrative, 1 hour of preparation and up to 4 hours mediation time. Typically can start at either 9:00 AM or 1:00 PM. Note: the hourly rate of $175 per hour applies if counsel requests additional preparation time by Mr. Tanksley or if counsel requests to extend the session (assuming availability).

Hourly: $175 per hour, minimum 4 hours (includes administrative charge and required minimum 1 hour preparation time and 3 hours mediation time).

Note: Upon inquiry, Mr. Tanksley may be agreeable to other arrangements, however the below fee schedule applies unless otherwise confirmed by him in writing. Please also note that, while Mr. Tanksley does not rush the process and normally will pursue the mediation as long as the parties will support the effort, the following fee structure often actually rewards reaching a resolution promptly, if feasible, which is presumably what the parties would prefer: 

Cancellations: Administrative charge of $200 if cancel on more than 15 calendar days notice. Otherwise, up to 50% charge plus any preparation time for cancellation on notice of 5 to 15 days and up to 75% charge, at Mr. Tanksley's discretion, for cancellation within final 5 calendar days, except if and to the extent that mediation fees may be received from another matter during the same time slot. Additional charges may apply, at Mr. Tanksley's discretion, for cancellation of a multi-day session.

 

Case Settles Early: The goal of mediation is to reach a settlement as soon as the opportunity to do so is reached; if a case is       settled before the daily, half-day, or hourly allotted time has been fully utilized, there is no refund for any "unused" (paid for) time in cases of one day or less.

If more than one day was scheduled and deposits were received, then (unless otherwise agreed) there will be a 50% refund for any additional days (or a 50% charge if no deposit was actually received).

 

Eleventh Hour Special Rates Pending Availability: Similar to "last minute" cruise and resort discounts, if a mediation is requested on less than 11 calendar days notice and the requested date has not yet been blocked out, a comprehensive 20% discount is offered.

 

Arbitration Fees: The above provisions for mediation services also apply for services as a private arbitrator, less a 20% discount. Preparation time hourly fees apply both to preparation for the arbitration and to preparation of the award and decision for the arbitration, subject to advance approval of time by counsel.
